Terms of Service

These Terms of Service govern your use of Foveal, an AI visual attention prediction tool made by Kinoko Studio. By using Foveal you agree to these terms.
Who we are
Foveal is operated by Kinoko Studio (Hong Kong), available at foveal.kinokostudio.com.hk. References to "we", "us", or "our" mean Kinoko Studio.
Your account
Foveal uses Google Sign-In. You need a Google account to use the service beyond the sign-in screen. You are responsible for keeping your account secure and for all activity that happens under it. One account per person.
Credits
Foveal operates on a credit system. Each analysis costs one credit.
- Welcome credits — new accounts receive a one-time bonus of 15 free credits when they first sign in. These never expire.
- Paid credits — you can purchase credit packs at any time. Paid credits never expire and carry over indefinitely.
All credit purchases are final. We do not offer refunds on credit packs once purchased, except where required by applicable law. Credits have no monetary value and cannot be transferred or exchanged for cash.
Payments
Payments are processed by Stripe. By purchasing credits you also agree to Stripe's terms. We do not store your card details. Purchase records are kept for accounting purposes as described in our Privacy Policy.
Acceptable use
You agree not to use Foveal to:
- Upload images that are illegal, infringing, defamatory, or that violate others' rights, including images that depict minors in a sexual manner.
- Attempt to reverse-engineer, scrape, or extract the underlying models or technology.
- Automate requests in a way that abuses the service or interferes with other users.
- Circumvent or manipulate the credit system.
We reserve the right to suspend or terminate accounts that violate these terms.
Your images and content
You own the images you upload. By uploading an image you confirm you have the rights to use it, and you grant us a limited licence to process it and store the result in your private analysis history as described in our Privacy Policy. We do not claim ownership of your images or use them for any purpose other than providing the service to you.
Predictions, not measurements
Foveal provides AI-generated predictions of visual attention. These are statistical approximations based on machine-learning models — they are not a substitute for laboratory eye-tracking studies or real human research. We make no guarantee that any result is accurate for a given image or audience.
Intellectual property
Foveal, its attention models, and all related technology and content are proprietary to Kinoko Studio. Nothing in these terms grants you any licence to Kinoko Studio's intellectual property beyond the right to use the service as intended.
Disclaimer of warranties
Foveal is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that results will be accurate for your purposes.
Limitation of liability
To the fullest extent permitted by law, Kinoko Studio is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Foveal. Our total liability for any claim arising from these terms or your use of the service is limited to the amount you paid us in the 12 months before the claim.
Changes to these terms
We may update these terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, notify you when you next sign in. Continued use of Foveal after an update constitutes your acceptance of the revised terms.
Governing law
These terms are governed by the laws of Hong Kong SAR. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
